420 with CNW – Illinois Governor Signs Two Bills Expanding Medical Marijuana Program

As another sign of his pledge to make marijuana accessible to Illinois residents, Gov. J.B. Pritzker signed two more bills on Monday expanding the medical marijuana program of the state. He stated that the signing ceremony was a message to all medical marijuana users in the state that the state government was on their side.

Senate Bill 2023 was intended to make the medical marijuana program permanent in Illinois. Under the law which legalized medical marijuana back in 2013, the program was transitional and had been given a lifespan of four years.

This particular bill also added 11 conditions to the list of qualifying conditions for which patients can get a recommendation from a doctor to use medical marijuana. The additional conditions include migraines, irritable bowel syndrome, chronic pain, polycystic kidney disease and several other conditions.

Starting in January next year, patients on the medical marijuana program will also be allowed to grow a maximum of five cannabis plants. These plants should be in locked areas that are far from public view.

As soon as Senate Bill 2023 was signed, physicians’ assistants and nurse practitioners were allowed to start certifying patients who wished to enroll on the medical marijuana program.

Senate Bill 455 was also signed on Monday. Under this law, kids who are registered to use medical cannabis can now starting getting their treatment on school premises as long as the administration of the medical marijuana is supervised by a member of staff at the school.

The bill also emphasizes that no one who hasn’t attained the age of 21 will be allowed to legally buy marijuana that can be smoked.

The medical marijuana program has seen many modifications from the original program of 2013 which was variously described as too restrictive. For example, under that law, patients had to get a written recommendation from a doctor before being certified to use medical marijuana and they could only buy 2.5 ounces every fortnight. The patients also had to make a pledge that they would never use medical marijuana in the presence of kids or in public. The number of qualifying conditions was also smaller, but most of these restrictions have gradually been eased.

Additionally, the state instituted an Opioid Alternative Pilot Program in February. Under this program, Illinois residents who have opioid abuse problems can have an accelerated path to temporary access to medical cannabis.

As the country counts down to next year when recreational marijuana will become available to residents, experts believe that marijuana industry participants like Golden Developing Solutions Inc. 420 with CNW – Florida Legislator Files Marijuana Decriminalization Bill

Rep. Shevrin Jones (D) has filed a bill in the Florida Assembly seeking to decriminalize the possession of up to 20grams of marijuana. This bill comes at a time when campaigners who wish to have marijuana legalized through a ballot measure have collected and submitted the number of voter signatures required before the Supreme Court of the state can review the language of their petition.

In a press release, Jones said that he was pleased to file this bill as a way to fix the broken criminal justice system of the state. The existing marijuana laws have disproportionately affected people of color who end up losing their student financial aid, access to housing loans, denial of job opportunities and so many other collateral effects of having a marijuana possession conviction on one’s criminal record. Jones adds that he is proud to introduce this law which will put an end to more Floridians being adversely affected by these laws which are implemented in a selective manner.

The bill also makes the possession of less than 600miligrams of THC a non-criminal offense that is punishable by a fine rather than jail time.

Marijuana law reform advocacy groups, such as NORML, have welcomed this new bill saying that Florida has a reputation of having some of the most draconian marijuana laws in the country, so any measure that pegs back those punitive policies will provide much needed relief. NORML pledged to support the legislator in any way they can to ensure that the draft legislation passes in both legislative chambers of the state.

Meanwhile, it isn’t yet clear whether marijuana will be legalized in Florida since attempts to do so legislatively failed and the push to refer the matter to voters is still in its infancy.

However, some jurisdictions within the state have taken matters into their own hands and they are initiating local laws decriminalizing low-level marijuana possession. Cocoa Beach for example approved a measure in May to decriminalize the possession of less than 20grams of cannabis. Tallahassee is also likely to do the same if the efforts of one local lawmaker spearheading a decriminalization drive achieve the desired outcome.

As all this is going on, the state police has admitted that the legalization of industrial hemp has made it harder to prosecute marijuana possession cases. Police officers have therefore been advised to be extra vigilant so that they don’t prosecute people for marijuana-related crimes when those people had hemp, a plant that looks like marijuana but doesn’t cause any psychoactive effects.

420 with CNW – Bipartisan Senate Bill Seeks to Ease Marijuana Business Access to Insurance Services

A bipartisan bill introduced in the U.S. Senate on Monday seeks to ensure greater access to insurance policies for marijuana businesses in states where the drug is legal. The bill titled “Clarifying Law Around Insurance of Marijuana (CLAIM) Act” was sponsored by Sen. Bob Menendez (D-NJ). The cosponsors of the legislation are Sens. Jeff Merkley (D-OR), Rand Paul (R-KY) and Kevin Cramer (R-ND).

Currently, federal law makes it very difficult for cannabis businesses to get casualty, property and title insurance cover regardless of the state laws on the matter.

If the CLAIM Act is passed, insurance companies wouldn’t have to fear that they would be penalized or discouraged from selling insurance policies to companies that directly or indirectly serve the marijuana industry. For example, federal punitive action wouldn’t be taken against an insurer who covers the property managers hired by marijuana businesses.

Additionally, the law would bar federal agencies from incentivizing, encouraging or recommending that insurance companies refrain from working normally with a business in the marijuana industry or one indirectly serving the industry.

The draft law also includes protections for people who are employed by insurance companies. Its provisions free these people from being held liable for the work that they do when serving marijuana businesses.

While introducing the bill, Menendez said that marijuana businesses are unable to protect their customers, employees, premises and other property. The bill would therefore correct this situation and put cannabis businesses at par with businesses in other industries.

Sen. Rand Paul added to what Menendez said by saying that the basic principles behind the CLAIM Act are that the federal government should respect what the people in many states have decided and put an end to the barriers legitimate businesses are facing regarding access to basic protections.

The supporters of this bill assert that giving cannabis companies access to insurance cover would also remove some barriers to financing since many lending institutions automatically disqualify businesses that cannot get insurance cover.

While supporting this legislation, the media relations director of NCIA (national cannabis industry association) said that the wildfires in California and other cannabis growing regions had shown that the long-term survival of the marijuana industry depends on their ability to get insurance cover against all the foreseeable risks, just like other businesses do.

Gov. Phil Murphy (D) of New Jersey, who recently signed a law expanding the medical marijuana program of the state, also supported the bill introduced by Menendez. Murphy said it was important that medical marijuana providers are given the same protections that are the norm for the providers of other medical services.
